Conclusion of contracts and performance

Each order is preceded by a written contract or an offer confirmed by email, containing:

A detailed scope of work and technical specification.

The completion date and the schedule of stages.

The remuneration and method of payment.

The terms for the transfer of copyright.

The rules for making changes and corrections.

Before work begins, the Client accepts the offer and pays an advance (as standard, 20% of the project value, unless the contract provides otherwise).

Payments

Standard settlement model:

20% advance at the start of the project (after the contract is signed).

80% payable after the work is completed and the project is accepted by the Client.

For larger projects we divide the work into stages with partial payments. Each payment is preceded by the issue of a VAT invoice with a 7-day payment term (unless the contract provides otherwise).

Recurring services (SEO, advertising campaigns, IT support) are billed as a monthly subscription paid in advance, on the basis of a VAT invoice.

Failure to pay on time entitles the Service Provider to suspend work until the amount due has been settled.

Copyright

We transfer the full economic rights under copyright to the completed projects to the Client once all amounts due have been paid. The Client receives:

The project source code (Git repository or archive).

Access to the hosting, domain and administration panel.

Source files of graphic designs (.ai, .psd, .fig, .svg).

Accounts for tools related to the project (Google Analytics, Search Console, Ads).

Technical documentation (where applicable).

Until full payment is made, all rights remain with the Service Provider. The Service Provider reserves the right to present completed projects in its portfolio (unless the Client stipulates confidentiality).

Warranty and post-launch support

Each project is covered by a free 30-day warranty for technical errors resulting from our work. The warranty does not cover:

Functional changes made by the Client or third parties.

Failures of hosting, the domain or external services (payments, couriers).

Software updates (WordPress, plugins), which require a separate service contract.

Break-ins and hacking attacks resulting from negligence on the part of the Client.

After the warranty period we offer a service contract covering updates, backups, monitoring and 24/7 technical support.

Liability

The Service Provider exercises the utmost diligence in providing its services. The liability of the Service Provider is limited to the amount of remuneration received for the given service.

The Service Provider is not liable for:

Failures of external services (Google, hosting providers, payment operators).

The consequences of the Client breaching platform terms (e.g. a blocked Google Ads account).

Loss of profits or indirect damage.

Content supplied by the Client (photos, texts), including its compliance with copyright law.

The consequences of improper use of the supplied software by the Client.

Complaints

Complaints should be submitted in writing to the email address: kontakt@cyfrowapomoc.pl. A complaint should include:

The Client's first name and surname / company name.

The number of the contract or invoice to which the complaint relates.

A description of the problem and the expected method of resolution.

We consider complaints within 14 days of receipt. We inform the Client of the outcome by email.

Right of withdrawal (consumers)

A consumer who concludes a distance contract has the right to withdraw from it within 14 days without giving any reason (Article 27 of the Polish Consumer Rights Act), unless:

The service has been performed in full with the express consent of the consumer (Article 38(1) of the Act).

The subject of the service is digital content not supplied on a tangible medium, delivered with the consent of the consumer before the withdrawal period expired (Article 38(13) of the Act).

The statement of withdrawal should be sent to the email address kontakt@cyfrowapomoc.pl or in writing to the address of the registered office. A model withdrawal form is available in the annex to the Consumer Rights Act.

Dispute resolution

In the event of a dispute, both parties undertake to resolve the conflict amicably. If this is not possible, the dispute will be settled by the court having jurisdiction over the registered office of the Service Provider (Lublin), unless the law provides otherwise (e.g. in relations with consumers).

Consumers may use out-of-court dispute resolution methods, including the European Commission's ODR platform (ec.europa.eu/consumers/odr) and municipal/district consumer ombudsmen.

Final provisions

In matters not regulated herein, the provisions of Polish law apply, in particular the Polish Civil Code and the Polish Act on the Provision of Electronic Services.

The Service Provider reserves the right to amend these terms with 14 days' notice.
